ข้อกำหนดการให้บริการ
1. คู่สัญญาและการยอมรับข้อกำหนด
เอกสารนี้เป็นสัญญาผูกพันทางกฎหมายระหว่าง บริษัท วินด์ฟลู จำกัด ("บริษัท") และ ท่าน ("ผู้ใช้") การลงทะเบียน เข้าสู่ระบบ หรือใช้งานบริการใด ๆ ถือว่าท่านยอมรับข้อกำหนดเหล่านี้ทุกประการ หากท่านไม่ยอมรับกรุณาหยุดใช้งานบริการ
2. คำจำกัดความ
แพลตฟอร์ม Windflu AI Platform รวมถึงเว็บแอปพลิเคชัน API และบริการที่เกี่ยวข้องทั้งหมด
script บทพูด หรือข้อความใด ๆ ที่ระบบ AI สร้างขึ้นจาก prompt ของผู้ใช้
คำสั่งหรือข้อความที่ผู้ใช้ป้อนเข้าสู่ระบบ
ระดับการสมัครสมาชิก (subscription plan) ที่ผู้ใช้เลือก
3. สิทธิ์การใช้งานและข้อจำกัด
3.1 การใช้งานที่อนุญาต
ผู้ใช้ได้รับสิทธิ์ที่ไม่ผูกขาด ไม่สามารถโอนได้ และเพิกถอนได้ในการใช้บริการเพื่อ:
- สร้าง script, บทพูด, caption, และ content outline สำหรับงานส่วนตัวหรืองานเชิงพาณิชย์
- แก้ไขและปรับเปลี่ยน Generated Content
- เผยแพร่ Generated Content บน platform ของตนเอง
- ใช้ Generated Content ในงานลูกค้าและสื่อโฆษณา (ตามเงื่อนไขลิขสิทธิ์ในข้อ 5)
3.2 การใช้งานที่ห้ามอย่างเด็ดขาด
ด้านเนื้อหา
- สร้างเนื้อหาที่ละเมิดกฎหมายไทย รวมถึง พ.ร.บ. คอมพิวเตอร์ พ.ศ. 2550
- สร้างเนื้อหาที่หมิ่นประมาท เป็นเท็จ ส่งเสริมความเกลียดชัง หรือก่อความรุนแรง
- สร้างเนื้อหาที่เกี่ยวกับการล่วงละเมิดทางเพศเด็ก (CSAM)
- สร้าง deepfake หรือเนื้อหาที่หลอกลวงซึ่งสร้างความเสียหายแก่บุคคลอื่น
ด้านเทคนิค
- ทำ reverse engineering, decompile, หรือพยายามเข้าถึง source code
- ใช้ bot หรือ script อัตโนมัติเพื่อใช้งานเกินกว่า rate limit ที่กำหนด
- พยายามเจาะระบบ ทดสอบช่องโหว่ หรือรบกวนการทำงานของบริการ
- ขาย แบ่งปัน หรือโอนสิทธิ์การเข้าถึงบัญชีให้ผู้อื่น
ด้านทรัพย์สินทางปัญญา
- อ้างสิทธิ์ความเป็นเจ้าของ Windflu AI Platform หรือเทคโนโลยีที่เกี่ยวข้อง
- ใช้ชื่อ โลโก้ หรือเครื่องหมายการค้าของบริษัทโดยไม่ได้รับอนุญาต
4. การลงทะเบียนและความรับผิดชอบของบัญชี
- ท่านต้องมีอายุครบ 18 ปีบริบูรณ์ หรือได้รับความยินยอมจากผู้ปกครอง
- ท่านรับผิดชอบต่อกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของท่าน
- ท่านต้องแจ้งเราทันทีหากพบว่าบัญชีถูกเข้าถึงโดยไม่ได้รับอนุญาต
- ข้อมูลที่ลงทะเบียนต้องเป็นความจริงและเป็นปัจจุบัน
5. ลิขสิทธิ์และทรัพย์สินทางปัญญา
5.1 เนื้อหาที่ผู้ใช้สร้าง (Generated Content)
ท่านเป็นเจ้าของ Generated Content ที่สร้างจาก prompt ของท่าน บริษัทมอบสิทธิ์การใช้งานอย่างไม่ผูกขาดทั่วโลก รวมถึงเชิงพาณิชย์ อย่างไรก็ตาม เนื่องจาก AI model อาจสร้างเนื้อหาที่คล้ายกันสำหรับผู้ใช้คนอื่น บริษัทไม่รับประกันว่า Generated Content จะมีลักษณะเฉพาะหรือสามารถจดทะเบียนลิขสิทธิ์ได้
5.2 Prompt Input
บริษัทได้รับสิทธิ์ที่จำเป็นในการประมวลผล prompt ของท่านเพื่อให้บริการ รวมถึงการส่งต่อไปยัง AI model providers ตามที่ระบุในนโยบายความเป็นส่วนตัว
5.3 ทรัพย์สินของบริษัท
แพลตฟอร์ม Windflu AI Platform รวมถึง interface, โลโก้, เทคโนโลยี, และซอฟต์แวร์ทั้งหมด เป็นทรัพย์สินของบริษัทและได้รับการคุ้มครองตามกฎหมายทรัพย์สินทางปัญญา
6. การชำระเงินและการสมัครสมาชิก
- ราคาและเงื่อนไขแพ็กเกจระบุบนหน้าเว็บ อาจเปลี่ยนแปลงได้โดยแจ้งล่วงหน้า 30 วัน
- บริการสมัครสมาชิก (subscription) จะ ต่ออายุอัตโนมัติ ท่านสามารถยกเลิกได้ก่อนวันต่ออายุ
- ไม่มีการคืนเงิน (refund) สำหรับระยะเวลาที่ผ่านมาแล้ว ยกเว้นกรณีข้อผิดพลาดทางเทคนิคหรือตามที่กฎหมายกำหนด
- หากการชำระเงินล้มเหลว บริการอาจถูกระงับชั่วคราวจนกว่าจะชำระเงินสำเร็จ
7. ข้อจำกัดความรับผิด (Limitation of Liability)
7.1 การให้บริการ "ตามสภาพ" (As-Is)
บริการจัดให้ "ตามสภาพที่เป็นอยู่" บริษัทไม่รับประกันว่าบริการจะทำงานได้โดยไม่มีการหยุดชะงัง Generated Content จะถูกต้องสมบูรณ์ หรือบริการจะตอบสนองความต้องการทั้งหมดของท่าน
7.2 ขอบเขตความรับผิด
บริษัทจะไม่รับผิดต่อความเสียหายทางอ้อม อุบัติเหตุ หรือที่เป็นผลต่อเนื่อง ความรับผิดรวมสูงสุดจะไม่เกิน ยอดเงินที่ท่านชำระในช่วง 3 เดือนก่อนหน้า หรือ 1,000 บาท แล้วแต่จำนวนใดจะมากกว่า
7.3 ข้อยกเว้น
ข้อจำกัดข้างต้นไม่ใช้บังคับกับความเสียหายที่เกิดจากความประมาทเลินเล่ออย่างร้ายแรง หรือการกระทำโดยเจตนาของบริษัท
8. การระงับและยกเลิกบัญชี
8.1 การยกเลิกโดยผู้ใช้
- ท่านสามารถยกเลิกบัญชีได้ตลอดเวลาผ่าน Settings > Account > Delete Account
- เมื่อยกเลิก ข้อมูลของท่านจะถูกลบตามกำหนดเวลาใน Privacy Policy
8.2 การระงับหรือยกเลิกโดยบริษัท
บริษัทขอสงวนสิทธิ์ในการระงับหรือยกเลิกบัญชีทันทีหากท่านละเมิดข้อกำหนด ใช้บริการในทางที่ผิดกฎหมาย หรือไม่ชำระเงินตามกำหนด ในกรณีที่ไม่เร่งด่วนจะแจ้งเตือนล่วงหน้า 7 วัน
9. การเปลี่ยนแปลงข้อกำหนด
- การเปลี่ยนแปลงที่สำคัญจะมีผลบังคับใช้ไม่น้อยกว่า 30 วัน หลังแจ้ง
- หากท่านไม่ยอมรับการเปลี่ยนแปลง ท่านต้องยกเลิกบัญชีก่อนวันที่มีผลบังคับ
- การใช้งานต่อเนื่องถือว่ายอมรับข้อกำหนดฉบับใหม่
10. กฎหมายที่ใช้บังคับและการระงับข้อพิพาท
ข้อกำหนดนี้บังคับและตีความตาม กฎหมายไทย ข้อพิพาทให้พยายามระงับโดยการเจรจาก่อน หากไม่สำเร็จภายใน 30 วัน ให้ฟ้องต่อ ศาลที่มีเขตอำนาจในกรุงเทพมหานคร
11. บทบัญญัติทั่วไป
- การแยกส่วน: หากข้อกำหนดใดขัดต่อกฎหมาย ให้ข้อกำหนดที่เหลือยังคงมีผล
- การสละสิทธิ์: การที่บริษัทไม่บังคับใช้สิทธิ์ในกรณีใดไม่ถือเป็นการสละสิทธิ์
- สัญญาทั้งฉบับ: เอกสารนี้ร่วมกับ Privacy Policy เป็นสัญญาทั้งฉบับ

Terms of Service
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between Windflu Co., Ltd. ("Company", "we") and you ("User") governing your use of Windflu AI Platform ("Service"). By registering, accessing, or using the Service, you agree to these Terms. If you disagree, please discontinue use immediately.
2. Definitions
Windflu AI Platform, including the web application, API, and related services
Scripts, dialogues, or any text produced by the AI from your prompts
Input text or instructions you submit to the Service
A subscription tier you have selected
3. Permitted and Prohibited Uses
3.1 Permitted Uses
You are granted a non-exclusive, non-transferable, revocable license to:
- Create scripts, dialogue, captions, and content outlines for personal or commercial purposes
- Edit and adapt Generated Content
- Publish Generated Content on your own platforms
- Use Generated Content in client work and advertising materials (subject to Section 5)
3.2 Prohibited Uses
Content-related
- Generate content that violates Thai law, including the Computer-Related Crime Act B.E. 2550
- Create defamatory, fraudulent, hate-inciting, or violence-promoting content
- Generate child sexual abuse material (CSAM) of any kind
- Create deepfakes or deceptive synthetic media that harms real individuals
Technical
- Reverse-engineer, decompile, or attempt to access source code
- Use bots, automated scripts, or any method to circumvent rate limits
- Probe for vulnerabilities or disrupt service operations
- Share, sell, or transfer account credentials
Intellectual Property
- Claim ownership of the Windflu AI Platform or its underlying technology
- Use our trademarks or branding without prior written permission
4. Account Registration
- You must be 18 years or older (or have parental consent if applicable)
- You are solely responsible for all activity under your account
- Notify us immediately of any unauthorized account access
- Registration information must be truthful and kept up to date
5. Intellectual Property Rights
5.1 Generated Content Ownership
You own the Generated Content created from your prompts, subject to: the Company grants you a worldwide, non-exclusive license for any purpose including commercial use. Because the same AI may produce similar output for other users, the Company makes no guarantee that Generated Content is unique or eligible for copyright registration. You are responsible for verifying no third-party rights are infringed before use.
5.2 Your Prompt Input
You grant the Company a limited license to process your prompts solely for delivering the Service, including transmission to AI model providers as described in the Privacy Policy.
5.3 Company Property
The Windflu AI Platform — including its interface, logo, technology, and software — is the exclusive property of the Company and is protected by applicable intellectual property laws.
6. Payment and Subscriptions
- Prices and plan terms are listed on the website and may change with 30 days' notice
- Subscriptions auto-renew per the selected billing cycle; cancel before renewal date to avoid charges
- No refunds for elapsed service periods, except for verified technical failures or as required by law
- Failed payments may result in temporary suspension until payment is resolved
7. Limitation of Liability
7.1 Service Provided "As-Is"
The Service is provided "as-is" and "as-available." The Company makes no warranty that the Service will be uninterrupted or error-free, that Generated Content will be accurate or fit for any specific purpose, or that the Service will meet all your requirements.
7.2 Liability Cap
To the maximum extent permitted by Thai law, the Company shall not be liable for indirect, incidental, special, or consequential damages. The Company's aggregate liability shall not exceed the greater of: fees paid in the 3 months preceding the claim, or THB 1,000.
7.3 Exceptions
The above limitations do not apply to damages caused by the Company's gross negligence or intentional misconduct, or where Thai law prohibits such limitation.
8. Account Suspension and Termination
8.1 Termination by You
- Cancel anytime via Settings > Account > Delete Account
- Data will be deleted per the retention schedule in our Privacy Policy
8.2 Termination by Company
We may suspend or terminate your account immediately for Terms violations, illegal use, or non-payment. For non-urgent violations, we will provide 7 days' written notice before suspension.
9. Changes to These Terms
- Material changes take effect no less than 30 days after notification
- If you disagree with changes, you must close your account before the effective date
- Continued use constitutes acceptance of the revised Terms
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. Disputes shall first be resolved through good-faith negotiation (30-day period); failing that, disputes shall be submitted to the competent courts of Bangkok.
11. General Provisions
- Severability: If any provision is found unenforceable, remaining provisions stay in force
- Waiver: Failure to enforce any right does not constitute a waiver
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the complete agreement
